On November 22, the National Preventive Mechanism team visited the Sombor Reception Center for Migrants for the third time. Although it was an unannounced visit, the Center was find in good condition and the NPM team noted that most of the works announced during the previous visit were completed, and that there is a plan to build more contents. It has also been determined that it was acted upon all recommendations that the NPM had sent to the Commissariat for Refugees and Migration before.

The visit report was submitted to the Reception Center, the Commissariat, the Center for Social Work Sombor and the Ministry of Labor, Employment and Veterans' and Social Affairs.

The Commissariat for Refugees and Migration informed the National Preventive Mechanism (NPM) that, acting in accordance with the recommendation from the Report on the visit to the Bujanovac Reception Center for Migrants, a notice about the possibility of and procedure for filing complaints against the persons working in this Center was displayed inside the Center.

During the visit to the Šid Reception Center, which was conducted in December of 2016, the NPM has determined that it is necessary for the Commissariat for Refugees and Migration to take measures to prevent any inadequate treatment of migrants by the staff and recommended to Commissariat to establish an effective mechanism for complaints against their work and to display the notices about that in all migrant accommodation centers. According to the information received by the NPM from the Commissariat, the notice was previously pointed out in the Bujanovac Center, but the migrants removed it, so steps were taken to put it in such a way that it could not be easily removed.

The NPM visited the Bujanovac Reception Center in August and October this year, about which the reports were made. The second visit was conducted within the "Ombudsman Day", held on October 16 and 17 in Bujanovac and Niš.

The Vranje District Prison informed the National Preventive Mechanism (NPM) that, acting on the recommendations made, it designated premises for persons held by the police, in order to separate them from detained and convicted persons, and that it will take measures to ensure that every person is provided with as many living space as is foreseen in the modern standards, until the expansion of accommodation capacities. At the same time, access to the toilet is alleviated for people with disabilities and those that have difficulties to walk, works on the adaptation of toilets are under way and completely new sleeping mattresses, produced in the Niš Penitentiary Institute, were provided. In addition, the worn-out kitchen elements were replaced, new equipment for the kitchen was purchased and freshly fruits and vegetables were added to the menu.

Persons deprived of their liberty who do not understand the Serbian language are informed about their rights and duties during their stay in the Prison in a language they understand. Acting on the recommendations, the Prison improved the provision of legal assistance during the disciplinary procedure, handling the requests of pdl’s and the documenting the use of coercive means. In treatment, group work is intensified and prisoners will be offered more training, courses and cultural and artistic activities, as well as the use of a gym. In accordance with the recommendation, the Prison equipped the room for visits of close relatives.

After the visit the NPM team, the District Prison acquired the missing equipment for the infirmary and received the Ministry of Health decision on the fulfillment of the conditions for performing health care in general medicine. Neuropsychiatrist services are also provided for persons deprived of their liberty. Correcting the identified deficiencies, special record for injuries was established and secured that the therapy for persons deprived of liberty is not distributed by non-medical staff, and that the person's medical examinations as a rule are performed only in the presence of health care workers. In addition, the keeping of records of deaths has improved, while the prison doctor submits to the warden periodical reports on the health condition of pdl’s and on the state of hygiene in the Prison, with recommendations for improvement.

The Administration for the Execution of Criminal Sanctions informed the NPM that at this moment there is no legal basis for change of the act on systematization and increasing the number of full-time employees, but that they have submitted requests for a higher number of temporary employees. At the same time, video surveillance has been improved in the Prison, measures have been taken to provide members of the Security Service with the uniforms and employees entitled to an accelerated pension plan are sent for medical controls, which they did not have for a long time.

Acting upon recommendation of the NPM, the Commissariat for Refugees and Migration stated that the notification on the complaints of migrants to the work of officials in the Receptio Center Presevo will be hoisted and displayed in a visible place. In order to improve and equalized treatment migrants in reception centers, from the beginning September 2017, and at the Reception Center in Presevo, meetings of officials and representatives of migrants are organized periodically, on which migrants are informed about their rights. Also, the issue of water supply is solved, so that all migrants have access to hot water in the Center.

NPM visited the Reception Center in Presevo in august 2017. About this visit was made report with recommendation for removing the observed shortcomings in the work and improvement of the position of migrants.

Acting on the recommendations of NPM, police officers of the police stations Savski venac and Stari grad inform all detained persons about their rights in accordance with the Instructions on treatment of arrested and detained persons and make a record of detention. The record after the termination of detention is signed by the detained person or a statement is recorded that person refused to sign the minutes, and time of detention is calculated from the moment when the person was deprived of liberty, not from the moment of making a detentio decision.

In accordance with the recommendations of the NPM, after the use of force all detained persons are taken to a medical examination, and police officers attend medical examinations only at the request of a doctor, which is made up of an official note. In order to protect particularly sensitive data from medical records, in the cases of detained persons no longer are the reports and opinions doctors about their state of health. In order to make a more accurate assessment of the correctness and justifiability of the use of force, from detained persons, in the future will be taken written statements about police actions in the application of these funds.

In accordance with the recommendations of the NPM, police station Stari grad set up office for the protection of objects of committing crimes, as well as a special cash register for the storage of a higher value item.

In July 2017, NPM visited police stations Stari grad and Savski venac in order to follow the recommendations of the NPM Report from the visit to the Police Administration for the City of Belgrade and the Report to the Government of the Republic of Slovenia on the visit of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment CPT) to Serbia. After the visit, a Report with recommendations for further improvement of the position of persons deprived of their liberty was made.
